That’s why Herman Miller is suing a Canadian company for selling knock-offs of its famous mid-century modern designs by Charles and Ray Eames that have a place in the Museum of Modern Art in New York City. The suit, filed in federal court in Grand Rapids this week, accuses the Toronto-based New American, Inc. of copyright and trademark infringement, and unfair competition. Nuevo is likely to cause consumer confusion and is competing unfairly against Herman Miller by importing and selling furniture that incorporates one of the trademark designs or directly or indirectly uses one of the trademarked brand names, contends the company. “Nuevo sells its knock-off furniture items, directly or indirectly, to retailers, who sell the knock-off furniture to consumers, sometimes in connection with the Eames trademark,” according to the suit. under the monikers Sonoma, Churchill, Vesper and Soprano, the suit alleges.
